1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of SmartAssPDF.com, including all tools, features, websites, and services provided by SmartAssPDF (“SmartAssPDF,” “we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use SmartAssPDF.

2. About SmartAssPDF

SmartAssPDF provides online document utilities (e.g., PDF conversions, compression, merging, splitting, and related tools). We may add, remove, or modify tools at any time.

3. Eligibility & Accounts

  • You must be at least 13 years old (or the age of digital consent in your country) to use SmartAssPDF.
  • If you create an account, you are responsible for all activity under it and for keeping your credentials secure.
  • We may refuse registration, close accounts, or reclaim usernames at our discretion, subject to applicable law.

4. Services & Availability

  • Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation.
  • Maintenance, upgrades, or third-party issues may impact availability. We may limit usage to ensure platform stability.
  • We may introduce usage caps, rate limits, or fair-use rules for free tiers at any time.

5. User Content & Processing

  • You retain ownership of documents you upload (“User Content”). You grant us a limited, non-exclusive, worldwide license to process your User Content solely to provide the requested service (e.g., convert, compress, merge), troubleshoot issues, ensure security, and comply with law.
  • You represent and warrant that you have all necessary rights to upload and process the User Content and that your use complies with these Terms and applicable laws.
  • We implement reasonable technical and organizational measures to safeguard User Content. See our Security page and Privacy Policy for details.
  • Temporary processing copies may be created. Files are deleted per our retention practices described in the Privacy Policy.

6. Acceptable Use

You agree not to, and not to allow others to:

  • Upload or process content that is illegal, infringing, defamatory, obscene, or invasive of privacy.
  • Violate intellectual property rights or process content you do not have permission to use.
  • Interfere with or disrupt the Services, introduce malware, or attempt unauthorized access.
  • Scrape, crawl, or harvest data except as permitted by robots.txt and applicable law.
  • Bypass usage limits, attempt to reverse engineer, or resell the Services without our consent.
  • Use the Services to build competing products or for any high-risk activities where errors could lead to harm.

7. Intellectual Property

  • The SmartAssPDF website, tools, UI, logos, and trademarks are our property or our licensors’ and are protected by law.
  • You receive a limited, revocable, non-exclusive, non-transferable license to access and use the Services per these Terms.
  • Feedback is voluntary and may be used by us without obligation or compensation.

8. Payments, Plans & Refunds

  • Prices, features, and limits for any paid plans will be shown at checkout or on pricing pages.
  • Taxes may apply depending on your location. You authorize us to charge your payment method for recurring subscriptions, if applicable.
  • Unless stated otherwise, all sales are final. Refunds may be granted at our discretion for processing errors clearly attributable to our systems.
  • You can cancel future renewals anytime via your account or by contacting support. Access remains until the end of the current billing period.

9. Privacy & Data Protection

Our Privacy Policy explains how we collect, use, and protect personal data. If we act as a data processor for enterprise customers, our Data Processing Addendum (DPA) applies to that processing. By using the Services, you consent to our privacy practices.

10. Copyright/DMCA

If you believe content processed through our Services infringes your rights, send a detailed notice to support@smartasspdf.com including: (i) identification of the work and alleged infringement, (ii) your contact details, (iii) a good-faith statement of unauthorized use, and (iv) a statement under penalty of perjury that your notice is accurate. We may notify the user and/or remove access to allegedly infringing material as required by law.

11. Disclaimers

  • Services are provided “as is” and “as available” without warranties of any kind, express or implied.
  • We do not warrant that the Services will meet your requirements, be uninterrupted, secure, or error-free, or that output will be accurate or reliable.
  • You are responsible for validating outputs and maintaining backup copies of your files.

12. Limitation of Liability

To the maximum extent permitted by law, SmartAssPDF and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Services. Our aggregate liability for all claims relating to the Services shall not exceed the greater of (a) the amounts paid by you to SmartAssPDF in the 3 months preceding the claim, or (b) USD 50.

13. Indemnity

You agree to defend, indemnify, and hold harmless SmartAssPDF, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms or applicable law.

14. Suspension & Termination

  • We may suspend or terminate access immediately for suspected violations of these Terms, legal requirements, or security risks.
  • You may stop using the Services at any time. Certain provisions survive termination, including ownership, disclaimers, limitations of liability, and indemnity.

15. Changes to the Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., by posting on this page or via email, if available). Your continued use after changes become effective means you accept the updated Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Courts in Maharashtra, India shall have exclusive jurisdiction, unless otherwise required by mandatory consumer protection laws.
